Terms of Service for TimberArt Customers

These terms govern all business transactions with TimberArt. By ordering furniture or attending our workshops, you agree to these conditions. Please read them before placing orders.

Legal Framework for Our Business

TimberArt operates as a registered business in Bangalore, Karnataka, India. Our furniture sales fall under the Indian Contract Act, 1872. We comply with the Consumer Protection Act, 2019, which grants you specific rights as a customer.

Business Registration Details

TimberArt is registered with the Karnataka state government. GST registration number provided on all invoices. We maintain required business licenses for furniture manufacturing and retail sales.

Applicable Taxes

All quoted prices exclude GST (Goods and Services Tax). Current GST rate for wooden furniture is twelve percent. Final invoices show base price plus applicable GST separately. Prices may change if government tax rates change between quote and final payment.

Consumer Protection Rights

Under the Consumer Protection Act, you have rights to refunds for defective products and compensation for services not delivered as promised. These rights apply even if not explicitly mentioned in our individual order agreements.

What We Expect from Customers

Order Deposits and Payments

Custom furniture orders require fifty percent deposit to begin production. Deposit is non-refundable once we purchase wood for your order, which happens within two weeks of receiving deposit. Remaining balance is due when furniture is complete and you have inspected it.

Catalog items (standard designs from our product list) require full payment before delivery. We accept cash, bank transfer, UPI, and cheques from Indian banks. We do not accept credit cards or international payments.

Timelines and Delays

Quoted production times are estimates, not guarantees. Wood drying, weather conditions, tool breakage, and artisan illness can extend timelines. We inform you immediately if delays occur and provide revised completion dates.

You cannot cancel orders due to timeline delays unless actual completion time exceeds quoted time by more than four weeks. In such cases, full refund available.

Design Approval

Once you approve design drawings and we begin cutting wood, you cannot request major design changes. Minor adjustments possible during carving phase. Changes requiring additional wood or labor will be quoted separately.

Delivery and Access

You must ensure delivery personnel can access your building with furniture. If furniture does not fit through doorways or staircases despite measurements you provided, you are responsible for any modification work needed. We recommend professional measurement before ordering large pieces.

Inspection at Delivery

Inspect furniture immediately upon delivery. Report any damage within twenty-four hours. After this period, we cannot determine if damage occurred during delivery or after. Photographs required for damage claims.

Resolving Disagreements

Warranty Claims

Our one-year structural warranty covers joint failures and wood splitting under normal use. Warranty does not cover scratches, dents, finish wear, or damage from misuse. Bring warrantied furniture to our workshop or we collect it (collection charges apply outside Bangalore).

We repair or replace warrantied defects at our discretion. If replacement wood is unavailable, we refund the proportional cost of the defective component.

Mediation Before Legal Action

If direct discussion does not resolve your concern, we agree to participate in mediation before either party files legal action. Mediation costs split equally between TimberArt and customer. Bangalore-based mediator preferred for convenience.

Which Courts Handle Disputes

Any legal disputes will be handled in courts located in Bangalore, Karnataka. Indian law applies to all transactions. Both parties agree to submit to jurisdiction of Bangalore courts.

Limitation of Liability

TimberArt's maximum liability for any order cannot exceed the total amount you paid for that order. We are not liable for indirect damages, lost profits, or emotional distress claims.

Workshop Visits and Safety

Visiting Our Workshop

Customers are welcome to visit our workshop at MG Road, Bangalore during business hours. No appointment required for brief visits. If you want to spend more than thirty minutes discussing designs or watching artisans work, please call ahead so we can arrange proper time with Arjun Kumar.

Safety Rules in the Workshop

Our workshop contains sharp tools, heavy wood, and active machinery. Children under twelve must remain with parents at all times. Do not touch tools or equipment unless an artisan gives you permission. Stay in designated visitor areas marked with yellow lines on the floor.

We provide safety glasses if you want to watch carving work closely. Closed-toe shoes required in the workshop area. Sandals or flip-flops are not permitted near workbenches.

Liability for Workshop Accidents

TimberArt maintains liability insurance for workshop accidents. However, visitors who ignore safety instructions or enter restricted areas assume their own risk. If you sustain injury by not following clearly posted safety rules or staff instructions, we are not liable for medical costs or damages.

Photography in the Workshop

You may photograph your own furniture during visits. Please ask before photographing other customers' pieces or our artisans at work. Some clients prefer their custom designs remain private until delivery.

Cancellations and Refund Policy

Canceling Before Production Starts

You can cancel your order anytime before we purchase wood. Full deposit refund minus ₹2,000 consultation fee. Once we buy wood for your specific order (usually within two weeks of deposit), the deposit becomes non-refundable. The wood is cut to your measurements and cannot be used for other orders.

Canceling During Production

Orders cannot be canceled once carving begins. The labor hours invested cannot be recovered. If you absolutely must cancel mid-production, you forfeit the entire deposit and any additional payments made. We may offer to complete the furniture at reduced priority for future sale, but this is not guaranteed.

Rejecting Completed Furniture

If completed furniture matches approved drawings and agreed specifications, you cannot refuse to accept it. We build exactly what you approved in writing. If you change your mind about design or no longer want the furniture, full payment is still due.

If furniture does not match specifications, we correct the issues at no charge. This includes wrong dimensions, incorrect wood type, or carving patterns different from approved drawings.

Refunds for Defects

If we cannot repair a defect covered by warranty, we offer either replacement furniture or partial refund. Refund amount equals the portion of your payment allocated to the defective component. For example, if one chair in a six-chair set has irreparable defect, refund is one-sixth of the set price.

Refund Processing Time

Approved refunds are processed within fourteen business days. Bank transfers take three to five additional days to appear in your account. We provide written confirmation when refund is sent, including transaction reference number.

Changes to These Terms

We may update these terms occasionally. Changes apply to new orders placed after the update date. Orders already in progress follow the terms that were active when you placed your deposit. We post the last updated date at the top of this document.
